We're going to need your url so we can see what you are referring to.

so it seems to be only the top featured post i have added 3 different images to the "thumb" and they have all been cut on the top and bottom, the other 2 posts there on the featured are not doing this ??

I only see 4 thumbnails on the page, not 5. All of the thumbnails appear fine and they are smaller images. Any automated thumbnail program is going to do a worse job than a human working with the original image.

Charles,

There is definitely a marked difference between the top thumbnail (now have 6 or 7 in featured) and the remaining. The remaining are not cropped just shrunk, the top image is shrunk and cropped at the top and bottom only??

If you want absolute control over the look and feel of your thumbnail images, then create them yourself. If you want the convenience of not having to create thumbnail images yourself, get used to relying on some programmer having control over the resulting thumbnail.

StudioPress didn't develop the algorithm to create the thumbs. It is a popular algorithm developed by some guys at MIT. As I said earlier, any automated thumbnail program is going to do a worse job than a human working with the original image.

If you want to give input on how the algorithm works, tell Ben Gillbanks, one of the timthumb developers. He is working on a new version of timthumb.php.
