Ownership question

I'm hoping another designer on this forum might be able to answer this question for me....

Some time ago I designed a site for a local organization and did it as a volunteer service, not charging them anything for the design at all. I also host their site and they do pay for monthly hosting.

My question is - who is the actual owner of the design of the site - me or them? I think that it's me because the design was never purchased or paid for. The question is coming up because I want to make changes to the site to improve it and my suggestions have been met with some resistance. I'm reluctant to include this site as part of my portfolio anymore because they themselves have altered the organization & framework and as such, given the site a poor look overall.

I would really appreciate any thoughts or insight into this - sorry if it's off topic for this forum but I thought it would be a good place to try and find an answer!
