Default Remove "comments are closed"

I would like to remove the "comments are closed" box. I was able to delete the text by going into comments.php and taking out a few lines of code. but after doing this I still have this box under the mid page ad. The div class for this box is ".comments". Problem is if i take out the div it removes it from both pages with comments activated and without.

a little bit of help would be much appreciated :o)
