Question Genesis framework Genesis themes Trademarks?

Hello there -

I was reading over the new affiliate agreement and ran across something that, independent of the affiliate agreement, caught my attention. That is the listing of "Genesis framework" and "Genesis themes" among the StudioPress' trademarks.

Of course, you can make the terms of the affiliate program whatever you would like them to be, but the ramification of a trademark is much more far-reaching. So... do you consider "Genesis framework" and "Genesis themes" trademarks of CoppyBlogger and StudioPress or are they simply prohibited under the affiliate program?

The reason I would think this is an important distinction is in the context of the decision as to whether to continue to market using the Genesis phrases (i.e. announcing website services as "Built on the Genesis framework" etc.) or to instead completely re-brand the framework and themes for fear of some future potential hassle.

I had imagined that since the work is all GPL that marketing as "Genesis" framework/themes/what-have-you would be a helpful thing to build your brand of premium service offering. And frankly, it seems like I researched this already at some point and found that while you had trademarked StudioPress, you did not trademark Genesis in any form. Of course, I am not an attorney, and I only checked the one time so it could have changed since then. So rather than repeat my possibly-in-error-in-the-first-place research for technical answers, I would prefer to just hear about your strategy in regards to these issues so I can accommodate them in the most creative (and hopefully profitable) way possible.

So what's the thinking here?
