Off topic - Terms of Service by other web design companies

I wasn't sure where to post this topic but my question has to do with other web designer company's Terms of Service. I have not quite opened my web design business as I am just doing a little more research. I have seen a wide range out there of Terms of Service however I haven't seen any that says they require a signature from their customer for them to abide by their terms.

A lot of the terms specify exactly what the customer should expect and how the company is not liable for server crashes, etc.

So can all these terms I see floating around there really "stick" in a court of law if they are not getting their signature from their customer before starting their web design project?
